How Is Paternity Determined in California?

In California, it is the mother who decides if a man will be recognized as the father of a child. However, the father can request a paternity test to determine if he is the biological father of the child. If the test results find that the man is not the child's father, then he will not be required to pay child support.

After the paternity test, a court will issue an order that will recognize the father as the legal parent of the child. This order will establish the father's parental rights and responsibilities to the child, including the right to request custody or visitation. In addition, the father will be required to pay child support.
